
10. PREVAILING WAGES
TheContractorisrequiredtopaytheprevailingwagesasdeterminedunderthe
provisionsofChapter149,Sections26and27DoftheMassachusettsGeneralLaws,
includingthesubmissionofweeklypayrollstotheawardingauthority.Acopyofthe

11. MATERIALS
TheCityoritsAgentreservestherighttoapproveorrejectanysupplies,materialor
equipmentusedbytheContractor.TheContractoragreestoreplaceanysupplies,
materialorequipmentusedbytheContractor.TheContractoragreestoreplaceany
rejectedsupplies,materialsorequipment,tothesatisfactionofthe
CityoritsAgents.
12. TERMINATIONOFCONTRACT
ThiscontractmaybeterminatedbytheCityupondeliverancetotheContractorofa
five‐daywrittennoticeofsaidtermination.
13. CONTRACTOBLIGATIONS
ContractobligationsonbehalfoftheCityaresubjecttoanannualappropriationto
coverthecontractobligation.
14. BIDDEREXPERIENCEEVALUATION
Eachbiddershallsubmitwithhisbid,alltheinformationrelativetotheirexperience
andqualificationsinperformingtheworkrequiredunderthiscontractandshallhave
beeninbusinessforaminimumoffive(5)years,inorderfortheirbidtobe
considered.
15. NOT‐TO‐EXCEEDAMOUNT
Thebidamountproposedinyourcompany’sresponseisa“not‐to‐Exceed”amount
unlesstheCitymakeschanges,inwriting,tothescopeofworktobeperformed.The
ChangeOrdermustbesignedandapprovedbytheCity’sPurchasingAgent,City
Auditor,LawDepartmentandtheMayorpriortothecommencementofthechange
orderwork.Noworkistobeginuntiltheproperapprovalshavebeenobtained.A
changeorderwillbepricedattheunitprice.Failuretocomplywiththisprocedurewill
resultinthecancellationofthecontractandthenon‐paymentofservicesprovided
16. FINANCIALSTATEMENTS.
TheCitymayrequire,withinfive(5)daysafterthebidopening,acompleteand
detailedFinancialStatementpreparedbyaCertifiedPublicAccount,todeterminea
bidder’sfinancialstability.
17 BREACHOFCONTRACT/NONPERFORMANCE
IftheContractorshallprovideservicesinamanner,whichisnottothesatisfactionofthe
City,theCitymayrequestthattheContractorrefurnishservicesatnoadditionalcostto
theCityuntilapprovedbytheCity.IftheContractorshallfailtoprovideservices,which
aresatisfactorytotheCity,theCityinthealternativemaymakeanyreasonablepurchase
orContracttopurchaseservicesinsubstitutionforthoseduefromtheContractor.The
CitymaydeductthecostofanysubstituteContractfornonperformanceofservices
togetherwithincidentalandconsequentialdamagesfromtheContractpriceand
